Repeat - Square Footage Question
Since I didn't get any answer on my square footage question the first time, I thought I would ask again.
1) When reporting the square footage on a property, are you allowed to count the garage or attic space IF these spaces have been converted into living area? I would assume that you would need some type of permit or something.
2) If the square footage reported on the MLS includes the converted garage space, but public records indicate that the house is much smaller, does that mean that these particular owners didnt' file the proper permits and are lying to the general public in regards to the size of the house?
3) Is it unethical for the seller's agent, who I emailed about the square footage on this house, to say to me, "The square footage is reported by the seller, I just listened to what they told me. You have to check for yourself." I did check for myself and the house is much smaller according to public records.
In my view, this seller is deceiving the public. That makes me mad - some poor consumer is going to pay an extra $150K for house because it is 350 sqft bigger than it is supposed to be.
Someone please tell me - is it just me? Or is this wrong?

To assume that there are no unethical agents would be deficient in worldly wisdom - so beware.
Size of the property should be verified if any doubt exist in your mind. Seller is taking a large risk for legal problems if he is misrepresenting the property.
If public records show different from advertised, this is a FLAG and should be investigated. The selling agent is covering is backside. Remember who he is working for - not you.
If the seller is deceiving, it stands to reason that he/she would be hard to work with and you will have little trust in the transaction - if anything get good representation (not the seller's agent).
